Mykola Tomenko suggested that the President of Ukraine repeals the Order on Dismissal of National Council Member as such that does not comply with the Effective Legislation
Mykola Tomenko suggested that the President of Ukraine repeals the Order "On Dismissal of V. Liasovsky from the Office of the National Council on Television and Radio Broadcasting Member" from 24/11 2009 №961/2009as such that does not comply with the Effective Legislation.
M. Tomenko emphasized that he is ready to supply the President of Ukraine Secretariate with all the necessary informational-legal inquiry regarding legal basis for the appointing and dismissal of National Council on Television and Radio Broadcasting Matters that are determined by the Constitution of Ukraine and the Law "On National Council on Television and Radio Broadcasting Matters."
In particular, according to the article clause 3, the National Council member´s authorities commence from the day of its appointing and are efficient during five years except envisaged by the Law cases.
The Law envisages the possibility of pre-termed individual dismissal of the National Council on Television and Radio Broadcasting Matters neither by the Verkhovna Rada of Ukraine nor by the President of Ukraine.
M. Tomenko reminded that V. Liasovsky was appointed on the office of the National Council on Television and Radio Broadcasting Matters by the Order of the President of uKraine №595/2005 form 3 April 2005 and until the term limit is run out the President has no right to dismiss him as it is out of his competence.
